Terms of Use

These Terms of Use ("Terms") govern your access to and use of the websites at niswosakit.com and woonsocket.info (the "Site"), operated by NISWOSAKIT ("NISWOSAKIT," "we," "us," or "our"). By accessing or using the Site, you ("you") agree to be bound by these Terms, by the Privacy Policy, and by the Disclaimer and Editorial Standards, each of which is incorporated by reference. If you do not agree, do not use the Site.

1. Acceptance

Your access to and use of the Site constitutes your acceptance of these Terms. For actions involving payment or the submission of personal information, including making a contribution, subscribing to email updates, or submitting a form, you will be asked to affirmatively agree to these Terms and the Privacy Policy at the point of the action, and we may record that agreement and the version then in effect.

2. Eligibility

You must be of the age of majority in your jurisdiction, or otherwise legally capable of forming a binding contract, to use the Site. The Site is not directed to children under 13, and we do not knowingly collect their personal information.

3. Nature of the Site

The Site is an independent civic information project that compiles, presents, and analyzes public information concerning Woonsocket, Rhode Island. The Site is not a government website, is not the official record, and does not provide legal, financial, tax, real estate, voting, medical, or other professional advice. No advisory or professional relationship is created by your use of the Site. Where the Site and an official source conflict, the official source controls. For elections, the official sources are the Rhode Island Department of State (vote.sos.ri.gov) and your local board of canvassers.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial, lawful purposes. You may quote from and link to the Site with attribution. You shall not:

5. Accuracy and no reliance

Information on the Site is compiled from public sources and may be incomplete, out of date, or inaccurate. It is provided for general informational purposes only. You should not rely on the Site as your sole source of information for any decision, and any action you take based on the Site is taken at your own discretion and risk. The complete accuracy disclaimer appears in the Disclaimer and Editorial Standards, which forms part of these Terms.

6. Analysis and information concerning public figures

Portions of the Site summarize, compare, map, and analyze public information, including information concerning public officials, candidates, public bodies, businesses, property records, and public issues, and including where candidates or officials appear to stand on documented issues. Such material is drawn from public records and public statements, is cited to its sources, and constitutes our good-faith opinion and analysis based on disclosed facts. It may be incomplete or become out of date. It is not an endorsement of or opposition to any candidate, is not advice on how to vote, and is not paid political advertising. We are independent and are not affiliated, coordinated, or funded by any candidate, campaign, political committee, political party, or governmental body. Where our summary and a person's own current statement conflict, that person's own statement controls, and any person may submit a statement or request a correction through the Corrections and Right of Reply process. 7. Contributions

Contributions to NISWOSAKIT are voluntary. A contribution: (a) is not a purchase and provides no product, service, or access in return; (b) is not a tax-deductible charitable contribution, as NISWOSAKIT is not a registered 501(c)(3) organization and no portion of a contribution is deductible; and (c) is not a contribution to any candidate, campaign, or political committee and is not made in coordination with any of them. Contributions support the operating costs and ongoing work of the project as taxable revenue of the operator.

Political contributors. By making a contribution, you represent and warrant that you are not a candidate, campaign, political committee, political party, or an agent of any of them, and that your contribution is not made on behalf of, or in coordination with, any of them. We do not accept contributions from such sources and will refund any contribution we identify as originating from them, less any non-refundable payment-processing fees.

Processing. Payments are processed by Stripe. Your payment card details are entered directly into Stripe's secure interface and are not seen or stored by us. By contributing, you also agree to Stripe's applicable terms.

Refunds. Contributions are generally non-refundable. If you contributed in error or intended a different amount, contact us at contact@niswosakit.com within 30 days and we will refund the contribution. If you do not recognize a charge on your statement, please contact us before initiating a dispute so that we may promptly refund it.

8. Email communications

Subscription to email updates is optional and opt-in. If you subscribe, we use your email address to send updates about the project and elections, and you may unsubscribe at any time. See the Privacy Policy.

9. Intellectual property

As between you and us, the original text, design, maps, charts, formulas, and analysis on the Site, and our selection, coordination, and arrangement of the compiled data, are owned by us and protected by copyright and other laws. Underlying public records and government data belong to their respective sources, are credited where they appear, and are not claimed by us; facts and public records are not subject to copyright. Third-party fonts and software libraries are used under their respective licenses. Except as expressly permitted in Section 4, you may not reproduce, distribute, or create derivative works from the Site's proprietary content without our permission.

10. Copyright complaints

If you believe content on the Site infringes your copyright, contact us at contact@niswosakit.com with a description of the work, the location of the material on the Site, and your contact information, and we will review the matter promptly and remove or correct material as appropriate.

11. Third-party services

The Site relies on and links to third-party services, including Stripe (contributions), Mapbox (maps and directions), Kit (email), and external websites such as official election resources and mapping and rideshare handoffs. Your use of any third-party service is governed by that party's own terms and privacy policy, and we are not responsible for third-party services or websites.

12. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE CONTENT IS ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, PROFITS, OR OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR RELIANCE ON, THE SITE. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (a) THE TOTAL AMOUNT YOU CONTRIBUTED TO THE PROJECT IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS ($100).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for gross negligence or willful, wanton, or intentional misconduct. If any portion of this Section is held unenforceable, the remainder shall remain in effect and the limitation shall apply to the fullest extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless NISWOSAKIT and the individual who operates it from and against any claims, damages, losses, liabilities, costs, and reasonable attorneys' fees arising out of or relating to your use or misuse of the Site, your breach of these Terms or of any law, or your violation of any third-party right. This Section survives termination of your use of the Site.

15. Suspension and termination

We may, at our discretion, limit, suspend, or terminate your access to the Site or any feature, including for violation of these Terms. You may discontinue use of the Site at any time. Sections that by their nature should survive termination, including Sections 9, 12, 13, 14, and 16, shall survive.

16. Governing law; venue; jury waiver; limitations period

These Terms are governed by the laws of the State of Rhode Island, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in Rhode Island, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, each party waives any right to a jury trial. Any claim must be commenced within one (1) year after the cause of action accrues, or it is permanently barred.

17. Changes to these Terms

We may modify these Terms from time to time. The current version and its effective date will be posted on this page, and prior versions will be retained. Your continued use of the Site after a change constitutes acceptance of the modified Terms. Where a modification is material, we will seek your affirmative agreement before it becomes binding on you.

18. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, the Disclaimer and Editorial Standards, and the other policies they incorporate, constitute the entire agreement between you and us regarding the Site. You may not assign your rights under these Terms; we may assign ours to a successor of the project.
